Two state lawmakers introduced bills that, if enacted, would modify the concept of the so-called legitimate defense in order to allow residents to protect themselves at home and their businesses.
Assemblyman Jorge Nuñez proposed changes to the Penal Code to increase the range for business owners to defend their properties against those who causes damages or arrives with firearms.
The lawmaker justified the proposal with the recent increase of homicides and robberies.
The other measure was introduced by Assemblyman Bernardo Padilla who seeks to allow residents to defend their honor and property when a need is identified to repeal an attack.
The bill includes provisions to apply legitimate defense in case of trespassing even if the crime is committed in a property not owned by the victim.
As of today the law includes such principle but on a very limited basis.
The bill would change that principle to include the defense on an imminent attack within reasonable measures of defense.
Teenager arrested after shooting officers
A teenager was apprehended Saturday evening after shooting police officers in eastern Mexicali, authorities said.
The suspect was identified as Humberto “Doe,” 19.
The suspect was driving a 2003 BMW SUV at 10:30 pm in the area of Eighth Street and San Pedro Mezquital Avenue in the unincorporated area of Gonzalez Ortega, also known as Palaco.
Police agents were in an operation to find stolen vehicles when the driver observed the officers and fled at high speed towards Lázaro Cardenas Boulevard westbound.
The suspect took Roberto Montenegro Street that had no exit.
The driver then drove in reverse, impacting a patrol car.
The suspect shot his firearm against police officers.
No agent was indicted injured, authorities said.
An officer shot back and caused damage on a window and a door.
The suspect was stopped and arrested by Loma Alta Avenue.
The driver was transported to the eastern police station.
Man sentenced for robbery
A man was sentenced to 13 years and six months in prison after being found guilty of robbery charges, said he Attorney General’s office.
Assistant Attorney General in Mexicali Fernando Ramírez said a state judge sentenced Cristian Ernesto “Doe” based on evidence provided by state investigators.
The robbery incident was reported early Oct. 23, 2015 at a residence located at Sinaloa Avenue at Colonia Esperanza neighborhood, just west of Mexicali’s Civic Center.
The suspect allegedly entered the residence with the intent to commit burglary.
The victim told authorities the suspect caused damage in the main door and took a purse with documents, bank cards, electronic devices, cash, a computer, two cell phones, jewelry and the keys of two vehicles.
The suspect allegedly threatened the property owner, another woman and a minor.
The suspect was eventually arrested after feeling from the scene.
Alleged murderer arrested
A man who allegedly took part in the murder of another individual over four years ago in rural Mexicali was apprehended in Guadalajara, Jalisco, Mexico, said the Attorney General’s office.
Special Investigations Coordinator in Mexicali David Lozano said the suspect was identified as Benjamin “Doe,” 42, whom authorities were searching for his alleged involvement in the march 7, 2013 murder of José Israel Luna Torres at Ejido Heriberto Jara rural town.
The suspect also attempted to kill Luis Artega Luna, 27, Lozano said
The victims were found unconscious early march 7, 2017, in a dirt road south of the town.
Authorities determined Luna Torres was dead while Artega Luna was injured.
The victim was transported to Mexicali General Hospital with injuries of head trauma.
Authorities said the victims were attacked by three individuals with whom were drinking alcoholic beverages hours before in a residence located by Lagona Avenue at Fraccionamiento Real del Río subdivision in Mexicali.
Minutes before midnight one of the alleged murderers asked the victims to leave and do an undisclosed business.
The victims got on board of a Toyota Camry while the suspects left on a green vehicle towards ejido Heriberto Jara.
Both drivers stopped at the scene and the suspects attacked the victims.
The fatal victim died due to a shot on the head and the other was hit with a rock.
The suspects left the scene after the attack.
Detectives unveiled that Benjamin was working as a construction worker in Guadalajara, where the suspect was arrested by Jalisco Ministerial police officers.
One of the other two suspects was arrested on April 2013 and the second on Dec. 31, 2013 at Mexicali bus depot.
