    Legitimate defense bill introduced

    A state legislator introduced a legitimate defense bill in order to provide women tools to defend themselves during assaults by their significant ones

    A state lawmaker introduced a bill named Alina Law that, if enacted, would clear out legitimate defense in the cases of women who kill assailants.

    Assemblywoman Liliana Michel Sánchez, of the Morena majority, introduced the bill that would modify Baja California’s Penal Code and the Law of Women’s Access to a Violent-Free Life.

    The proposal is based on the case of Alina Mariel Narziso Tehuaxtle, a Tijuana woman who was assaulted by her fiancé on Dec. 12, 2019, after an argument.

    Narziso Tehuaxtle was sentenced to 45 years in prison for the assailant’s homicide.

    The lawmaker said the judge did not consider a legitimate defense in the case that has shown several anomalies.

    Assemblywoman Sánchez said the judge did not bring justice in the case from a gender-based perspective.

    The bill seeks to include such provisions in state law.

    According to the lawmaker, the measure seeks to make sure legitimate defense is presumed in cases where women repeal assaults from their significant others.

    The bill also includes provisions to exempt excess of legitimate defense when victims are under fear or confusion.

    “It is very important to judges to consider context,” Assemblywoman Sánchez said. “Many times, violence does have a story and background.”

    Suicidal femicide bill introduced

    A state lawmaker introduced a bill that seeks to include in the Penal Code the crime of suicidal femicide.

    Assemblywoman Dunnia Montserrat Murillo, of the Morena majority party, said the bill seeks to convict those who instigate or help a woman commit suicide.

    The legislator said Baja California fights against violent acts against women.

    However, the Assemblywoman admitted state law does not include provisions to punish those who help women to take their own lives.

    “Desperation, depression, and psychological trauma caused by violence reduce women’s self-esteem,” the lawmaker said. “After not finding hope or a reason to continue living, leads (women) to take their own lives.”

    The proposal, of enacted, would give sentences of up to a decade to those convicted for inducting, forcing of helping a suicidal woman.
